Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Kolect Mailer application (the "Service") provided by KolectAI. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

These Terms incorporate by reference the KolectAI General Terms of Service.

Use of Service

To use the Service, you must:

  • Be at least 18 years of age and able to form a binding contract
  • Provide accurate, current, and complete account information
  • Maintain the security of your account credentials
  • Be responsible for all activity under your account
  • Comply with all applicable laws, regulations, and third-party policies
  • Have proper authorization to send emails on behalf of your organization (if applicable)

Gmail Account Connection

Important: By connecting your Gmail account to Kolect Mailer, you authorize us to access and use your Gmail data as described in our Privacy Policy and in accordance with Google's API Services User Data Policy.

What You Authorize

When you connect your Gmail account, you grant Kolect Mailer permission to:

  • Send emails from your Gmail account on your behalf
  • Read email threads that you initiated through Kolect Mailer
  • Read replies to emails you sent via our Service
  • Access your basic profile information (name, email address)
  • Receive real-time notifications when you receive email replies

Scope Limitation

Kolect Mailer ONLY accesses email threads that you initiated using our Service. We do not access your entire Gmail inbox, emails you received independently, or emails you sent from other email clients.

Revoking Access

You can revoke Kolect Mailer's access to your Gmail account at any time by visiting your Google Account Permissions page and removing Kolect Mailer. Upon revocation, we will delete your Gmail data within 30 days as described in our Privacy Policy.

Acceptable Use Policy

Prohibited Activities

You agree NOT to use the Service to engage in any of the following activities:

Email-Related Prohibitions

  • Send spam, unsolicited bulk emails, or emails to recipients who have not opted in
  • Send emails that violate CAN-SPAM Act, GDPR, or other anti-spam laws
  • Harvest, scrape, or collect email addresses without authorization
  • Impersonate others or misrepresent your identity or affiliation
  • Send phishing emails, malware, or malicious content
  • Send emails containing illegal, defamatory, or harmful content
  • Violate any recipient's privacy rights
  • Use purchased, rented, or third-party email lists without proper consent

General Prohibitions

  • Violate any applicable laws, regulations, or third-party rights
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service for any illegal or unauthorized purpose
  • Transmit viruses, malware, or harmful code
  • Abuse, harass, threaten, or intimidate others
  • Violate Google's Terms of Service or User Data Policies

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice.

Your Responsibilities

You are solely responsible for:

  • Email Content: All emails you send through the Service, including their accuracy, legality, and appropriateness
  • Recipient Consent: Ensuring you have proper permission to contact email recipients and honoring unsubscribe requests
  • Compliance: Complying with email marketing laws (CAN-SPAM, GDPR, CASL, etc.) and industry best practices
  • Data Security: Maintaining the confidentiality of your account credentials
  • Account Activity: All actions taken through your account, including by any authorized users
  • Third-Party Policies: Complying with Google's Terms of Service and policies

You agree to indemnify and hold harmless KolectAI from any claims arising from your use of the Service or violation of these Terms.

Intellectual Property

The Service and its original content, features, and functionality are owned by KolectAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the content you create and send through the Service (your emails, contact lists, etc.). By using the Service, you grant us a limited license to process and display your content solely for the purpose of providing the Service to you.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

KolectAI does not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Emails sent through the Service will be delivered successfully
  • The Service will meet your specific requirements
  • Any errors or defects will be corrected
  • The Service is free from viruses or harmful components

You are solely responsible for ensuring email deliverability, including maintaining good sender reputation, following email best practices, and complying with recipient email provider policies.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOLECTAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of your account or data
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or harmful code transmitted through the Service
  • Any errors or omissions in any content
  • Failed email delivery or Gmail API disruptions
  • Any conduct or content of third parties using the Service

In no event shall KolectAI's total liability exceed the amount you paid to use the Service in the 12 months preceding the claim, or $100, whichever is greater.

Termination

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms or our Acceptable Use Policy
  • Sending spam or engaging in abusive email practices
  • Suspected fraudulent, abusive, or illegal activity
  • Violation of Google's policies or terms
  • Receipt of complaints about your email activity
  • Non-payment (for paid plans)

You may terminate your account at any time by discontinuing use of the Service and revoking Gmail access. Upon termination, your right to use the Service will immediately cease, and we will delete your Gmail data as described in our Privacy Policy.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will notify you by email or through a prominent notice in the Service at least 30 days before the changes take effect.

By continuing to use the Service after changes become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where KolectAI operates, without regard to its conflict of law provisions.
